01 / The agreement

About these Terms

These Terms of Service (the “Terms”) form a contract between you and Anastasia Aleksandrova, operating the Songico service (“Songico,” “we,” “us,” or “our”). They apply when you visit Songico, submit a story, use a preview or recipient page, or purchase a personalized song or related deliverable.

By using the service or placing an order, you agree to these Terms and the package details, price, delivery estimate, and other information shown to you at checkout. If you do not agree, do not use the service or place an order.

02 / Purchase

Orders, prices, and payment

Order details

Your order includes only the features, number of versions, review opportunities, revisions, format, and delivery window displayed for the selected package at checkout. Please review your contact information, creative selections, names, pronunciations, dates, and story details before submitting.

Acceptance

An order is accepted when we send an order confirmation. We may decline or cancel an order before production begins if we cannot fulfill it, the content violates these Terms, the price or package information contains an obvious error, or fraud or misuse is suspected. If we cancel an order for one of these reasons, we will refund amounts paid for work not provided.

Prices, taxes, and payment

Prices and the charged currency are shown before purchase. Payment is due upfront through the payment method offered at checkout. You are responsible for applicable taxes, duties, bank fees, and currency-conversion charges unless checkout states that they are included. A payment provider may process your payment under its own terms.

03 / Production

How Songico creates your order

Songico combines information you submit with creative tools and workflows. The Instant package is AI-assisted. Signature combines AI-assisted production with human lyric editing and the review features displayed at checkout. Artist involves collaboration with a professional producer as described for that package.

By expressly asking us to begin production, including by selecting an immediate-start option at checkout, you request that we start the personalized service before any otherwise applicable cancellation period has expired. The cancellation consequences in the Cancellations and refunds section then apply.

Generative tools can produce unexpected similarities, errors, or elements that do not match a prompt. Package-specific review and revision rights are designed to address eligible issues, but no creative service can guarantee a particular emotional reaction, artistic preference, or commercial result.

04 / What you share

Your stories and materials

You retain ownership of the stories, text, photographs, recordings, names, messages, and other material you submit (“Customer Materials”). You grant Songico and the service providers working for us a worldwide, non-exclusive, royalty-free license to host, copy, adapt, transcribe, arrange, process, and otherwise use Customer Materials only as reasonably needed to provide, secure, support, and improve your requested service, comply with law, and exercise our rights under these Terms.

You represent that you have the rights and permissions needed to submit the Customer Materials and authorize this use. This includes appropriate permission for personal information, photographs, voices, and private stories concerning other people. Do not submit material that you are not entitled to use or that creates an unreasonable privacy or safety risk.

We will not publish a private story, Customer Material, or finished song as a public example without separate, explicit permission. You control who receives a private reveal link, and you are responsible for forwarding or publishing that link.

05 / Creative rights

Ownership and permitted use

Songico and its licensors retain their rights in the service, brand, software, production methods, reusable tools, templates, and pre-existing material. Subject to payment in full and these Terms, Songico grants you a worldwide, perpetual, non-exclusive license to download, keep, play, display, and share the delivered song, lyrics, artwork, reveal page, and other final deliverables for personal, noncommercial purposes.

Commercial advertising, monetized distribution, paid synchronization, resale, sublicensing, minting as a digital asset, or use on behalf of a business requires a separate written license from Songico and may require additional third-party permissions.

Songico does not offer unauthorized voice cloning or impersonation. A voice reference may be used only through an expressly offered feature and with verifiable permission from the person whose voice is involved.

06 / Handoff

Delivery, review, and revisions

The delivery estimate shown at checkout begins after we have received payment and all information reasonably needed to start. A delay caused by missing information, late feedback, a requested scope change, or events outside our reasonable control may extend delivery. Rush delivery applies only when expressly purchased and confirmed.

Inspect your delivery promptly. Tell us about incorrect names, facts, pronunciations, missing files, or technical defects and provide enough detail for us to assess the issue.

• Instant: revisions are included only if displayed at checkout or required by law.
• Signature: includes one consolidated revision covering the eligible review described at checkout.
• Artist: includes the collaborative process and versions displayed at checkout.

A revision does not include a new recipient, story, concept, genre, or other material scope change unless we agree to it in writing, potentially for an additional fee.

07 / Changes of plan

Cancellations, refunds, and problems

You may request cancellation by emailing songicoapp@gmail.com. Before production begins, we will refund the order price. After production begins at your express request, any refund may be reduced by the reasonable value of work already completed and nonrecoverable costs. After personalized work is delivered, we do not offer a refund solely because you changed your mind or another person did not react as hoped.

If the service or deliverable is materially defective, materially differs from the confirmed order, or is not provided, contact us so we can investigate. Depending on the circumstances, we may correct or replace the affected deliverable, reperform the affected service, reduce the price, or issue a full or partial refund.

Nothing in these Terms limits a cancellation, refund, chargeback, warranty, or other consumer right that cannot lawfully be waived. Refunds are returned to the original payment method unless law requires otherwise.

08 / Boundaries

Acceptable use

You must not use Songico to create, submit, request, or distribute content that:

• is unlawful, fraudulent, threatening, exploitative, or deliberately harmful;
• infringes copyright, trademark, publicity, privacy, contractual, or other rights;
• contains sexual content involving minors or facilitates abuse or exploitation;
• impersonates another person deceptively or uses a voice without permission;
• contains malware or attempts to interfere with, probe, scrape, or bypass the service; or
• is intended to mislead people about its origin in a way likely to cause harm.

We may refuse, remove, or stop processing prohibited material and may restrict access when reasonably necessary to protect people, the service, or legal rights. Where appropriate, we will explain the action and refund prepaid amounts attributable to unprovided work, except where the issue results from your breach or law prevents a refund.

09 / Service expectations

Availability and warranties

We aim to provide the service with reasonable care and skill and to deliver the features confirmed in your order. Temporary interruptions may occur for maintenance, security, provider outages, or circumstances outside our reasonable control. Private links reduce casual access but are not a guarantee that a recipient or anyone they share the link with will keep material confidential.

Except for express promises in these Terms, your confirmed order, and warranties that cannot be excluded by law, the service is provided “as is” and “as available.” We do not guarantee uninterrupted availability, a specific artistic response, compatibility with every device, or suitability for a commercial purpose.

10 / Responsibility

Limits of liability

To the maximum extent permitted by law, Songico is not liable for indirect, incidental, special, exemplary, or consequential losses, or for lost profits, revenue, business, opportunity, goodwill, or data, arising from the service or these Terms.

To the maximum extent permitted by law, Songico’s total liability arising from an order will not exceed the amount you paid for that order. These limitations do not apply where exclusion or limitation is prohibited, including liability arising from fraud, willful misconduct, gross negligence, or personal injury caused by negligence where applicable law does not permit limitation.

You are responsible for claims caused by Customer Materials you had no right to submit or by your unlawful use of a deliverable. To the extent permitted by law, you will reimburse reasonable losses and costs resulting from such a third-party claim, but only to the extent caused by your breach of these Terms.

11 / General

General terms

Changes

We may update these Terms prospectively. The effective date at the top will change, and material changes will be communicated by a reasonable method. The Terms accepted when you place an order continue to govern that order unless you expressly agree otherwise or a change is legally required.

Governing law

These Terms are governed by the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law rules. We do not require an exclusive court or waive any consumer protection that applies regardless of this choice of law.

Force majeure

Neither party is responsible for delay or failure caused by events beyond its reasonable control, but this does not remove obligations to refund amounts paid for services that are not provided when required by law.

Entire agreement; severability; no waiver

These Terms, the confirmed order details, and policies expressly incorporated into them form the agreement about the service. If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remainder will continue. A delay in enforcing a right is not a waiver.

Assignment

You may not transfer an order or these Terms without our written consent. We may transfer these Terms as part of a genuine reorganization, financing, or sale of the service, provided that doing so does not reduce your nonwaivable rights.
